A diverse committee of experts has designed this special institute to examine the critical issues presented by oil and gas industry contracts for goods, services, and people, and provide practical tips for those involved in all stages of the contracting process. In-house lawyers, outside counsel, supply chain buyers, contract specialists, and others are called upon daily to negotiate, draft, and obtain signatures for commercial contracts based on all manner of forms, with varying degrees of modification or consideration of overt and hidden issues that can bite and lead to expensive disputes when problems arise, or the parties are not properly aligned.
Day one focuses on risk allocation and indemnification provisions, negotiating master service and purchase order agreements, EPC and construction contracts, managing oilfield claims, and insurance issues—from working with brokers to addressing pollution coverage. On day two, you’ll explore technology agreements, the IADC, safety commitments and on-site safety management, FLSA issues with contractors, the “battle of the forms,” produced water disposal contracts, and ethical considerations involving insurer bad faith.
