Taxpayer Protection Act Loses Court Case

CA Supreme Court Removes TPA from the November Ballot

Today, the California Supreme Court voted 7-0 in favor of the Governor and Legislative Leaders to remove the Taxpayer Protection and Government Accountability Act (TPA) from the November ballot. BOMA California is a strong supporter of TPA, which would have restored the two-thirds majority vote requirement for new taxes and give voters the right to vote on new and higher taxes.

This decision effectively erases the voice of 1.43 million voters who signed the petition to qualify TPA for the November ballot, going against long-standing precedent that they should not intervene in an election before voters decide qualified initiatives.

The TPA campaign and allies will continue to pursue all available avenues to combat the attack on taxpayer rights.

Government Affairs Update

Industry Sponsored Legislation Held in the Senate

Commercial real estate industry sponsored Assembly Bill 2433 (Quirk-Silva; D-Fullerton) has been held in the Senate after the author pulled it due to strong opposition from the Service Employees International Union (SEIU). The bill would have improved the building permit process and expedited important projects across the state, providing more flexible fee structures, expedited inspection timelines, and conditional employment of external professional services.

The commercial real estate industry remains committed to finding legislative solutions to address bureaucratic delays in the permitting process and we will continue to work to introduce common sense legislation.

Call To Action: Oppose Senate Bill 1103

BOMA California is advocating against Senate Bill 1103 (Menjivar; D – Van Nuys), which would disrupt the commercial leasing landscape by imposing requirements detrimental to both property owners and the small businesses and nonprofits this bill aims to protect. The bill has passed the Senate and is now set to be heard by the Assembly Judiciary Committee. We need your action - please contact members of the committee to urge them to oppose SB 1103. Contact information and a sample message have been provided. Thank you for your continued support of our industry.

Governor and Legislative Leaders Agree on PAGA Reform

Governor Newsom, legislative leadership and business and labor groups announced an agreement on needed reforms to the Private Attorneys General Act (PAGA) that avoids a contentious ballot measure campaign. The agreement aims to strengthen worker protections, encourage employer compliance, and streamline litigation processes.

PAGA is a California statute that authorizes aggrieved employees to bring actions for civil penalties on behalf of themselves, other employees, and the State of California against their employers for California Labor Code violations.

BOMA California supports the agreement and its meaningful reforms to have labor claims resolved and prevent unnecessary litigation costing employers billions.
