Subject : UCR Board/Seiko Soft's Violation of Idaho Business Law; Cease and Desist Demand

As you know, we are a truck permit company filing for Unified Carrier Registration on behalf of hundreds of our motor carrier clients. We are retained to make hundreds of UCR payments on behalf of motor carriers. On Thursday, April 18, 2019, Seiko Soft changed their online programming so that we are no longer issued receipts for payments we make. This interferes with our ability to provide receipts to our clients and defend against chargebacks, in which case we could lose money due to your new business practice. We believe this practice violates the  Idaho Uniform Electronic Transactions Act  in that we are an online purchaser entitled to a receipt under law.

My attorneys have been trying to reach you and Avelino Gutierrez since last Thursday when Seiko Soft stopped issuing receipts to permit companies who pay UCR on behalf of their motor carrier clients in an obviously malicious attempt to interfere with permit companies' businesses. That is, you either know or should know this would be the effect of your unlawful change in receipt issuance. You appear to be refusing to respond to my attorneys, copied here, who tried to amicably settle this matter directly with you in good faith.

As I believe this business practice violates the Idaho Uniform Electronic Transactions Act and/or other Idaho business laws and you have not been willing to talk to us, I have therefore filed a complaint against Seiko Soft with the Idaho Attorney General in reference to this matter. You should expect to hear from them shortly.

You are hereby directed to cease and desist from engaging in this unlawful practice any further. If you do not  immediately  advise us you will comply with the law and begin issuing to us and all permit companies receipts both for transactions already processed and transactions moving forward, we reserve the right to take whatever additional legal action necessary against you and/or the UCR Board to enforce our rights under the law either as an individual litigant or a class action.

Sincerely,

/s/ JAMES LAMB...
