Today, in a 49 page decision, the US Court of International Trade (CIT), via a 3 judge panel, unanimously ruled that the IEEPA tariffs imposed starting in February and later in April (i.e., the "fentanyl" and the "reciprocal" tariffs) of this year are illegal. We will issue another update this evening after we more fully digest the CIT's decision, but wanted to alert the trade that Trump's signature tariff actions have been invalidated by the CIT. Of course, it is a virtual certainty that the government will appeal and ask the CIT to stay the CIT's judgment pending any appeals.
