Mask Mandates: What Do They Mean for Moorpark Businesses?
Earlier this week, Governor Newsom announced that he would not extend the state's mask mandate past its February 15 effective date, except for a few very sensitive settings. This afternoon, Ventura County Public Health officials announced they are not extending a local mask mandate within Ventura County either. However, Cal/OSHA mask rules for workplaces will remain in effect. Unvaccinated people still need to wear masks indoors. Together, what does it all mean for Moorpark businesses?
1) In Some Settings, Masks Are Always Required Indoors (Even After February 16)
Masks will continue to be required indoors in the following settings, unless a person qualify for an exemption (See Part 4 below):
- Health Care Settings
- Long Term Care Facilities, Adult and Senior Care Facilities
- Indoors in K-12 schools, childcare, and other youth settings
- Public Transit (buses, trains, airplanes, taxis, ride-shares)
- Emergency shelters, homeless shelters, and cooling/heating centers
2) What Do I Have to Do for Customers? (Beginning February 16)
With unvaccinated individuals still required to wear masks and no easy way to determine if a customer is vaccinated or not, businesses may choose any of the following:
- Require all patrons to wear masks anyway - your choice.
- Implement a vaccine verification system to determine whether individuals are required to wear a mask - your choice.
- Provide information indicating unvaccinated individuals must wear masks, but allow individuals to self-attest that they are in compliance. Essentially, you can post a flyer and then assume a person walking in without a mask is vaccinated.
3) What Do I Have to Do for Employees?
-
Decide if you want employees to wear masks: Employers can still choose to require their employees to wear masks. Both state and county public health officials recommend masking when there is a high risk of transmission. (Beginning February 16)
-
You must provide masks for employees: Per Cal/OSHA rules, employers must still provide unvaccinated employees with NIOSH-certified respirator masks for use when working indoors or in a vehicle with others. Even if you don't require employees to wear masks, you must still make these masks available. (Even After February 16)
4) All Other Masking Exemptions Remain
Just as they are now, the following individuals are exempt from wearing masks at all times:
- Persons younger than two years old
- Persons with a medical condition, mental health condition, or disability that prevents wearing a mask
- Persons who are hearing impaired, or communicating with a person who is hearing impaired, where the ability to see the mouth is essential for communication
- Persons for whom wearing a mask would create a risk to the person related to their work
For more information, please refer to the State's website, which lists the requirements that take effect on Wednesday, February 16.
