The Georgia Court of Appeals recently addressed the attempt of a workers’ compensation insurer’s attempt to enforce a subrogation lien on the claimant’s recovery against a third party tortfeasor. The Court of Appeals rejected the insurer’s claim, finding that there was no way for the insurer to prove that the claimant was fully and completely compensated.

I have attached a detailed discussion of this decision which was prepared by Brett Penley of our office which is available by clicking the link to download the PDF. If you have any questions, or would like a copy of the full decision, please feel free to contact Brett directly along with any other attorneys in our office and we will be always be happy to assist with any questions you may have on this, or any other, Georgia workers' compensation law issue.

Many Thanks,

Doug
