Ontario’s Construction Act Overhaul Explained

Key amendments include new provisions for defining “price” in contracts, mandatory annual holdback releases, and lienability of design services in certain scenarios. Changes to adjudication rules will expand the scope of disputes that can be resolved, introduce options for registry or private adjudicators, and extend deadlines for initiating adjudications. Transition provisions will govern the application of these amendments. Industry stakeholders should consult legal experts to adapt contracts and practices to align with these significant legislative changes.
