The Georgia Court of Appeals recently addressed the question of whether the exclusive remedy provision of the Workers’ Compensation Act protects corporate members of a joint venture which are statutory employers, as well as individual employees of those companies. The Court of Appeals found that each of the defendants in question were shielded from liability by the exclusive remedy provision.

I have attached a detailed discussion of this decision which was prepared by Brett Penley of our office which is available by clicking the link to download the PDF. If you have any questions, or would like a copy of the full decision, please feel free to contact Brett directly along with any other attorneys in our office and we will be always be happy to assist with any questions you may have on this, or any other, Georgia workers' compensation law issue.

Many Thanks,

Doug
