Issue No. 29 • Wednesday, July 23, 2025 • www.mbex.org

If it feels like inflation is the guest that showed up uninvited and refuses to leave...no, you're not imagining things. These days, people are still spending, but they are being more selective about where their dollars go. "Good enough" just isn't cutting it anymore. And in construction, that means tighter timelines, higher expectations, and some fierce competition. So how do you make sure you're the one getting the call back? That's where MBEX has your back. From boosting your visibility with GCs and subs in the Online Plan Room to building the kinds of relationships and connections that turn into contracts, we're here to help you stand out. (Also --- pro tip --- not returning calls or ghosting on charge orders? Not the best look 😉)

Five Quick Things To Know & Do This Week:

1.) IMPORTANT DATE CHANGE - As it often goes in Duluth, the weather has messed with our plans and we've decided to postpone our Lake Superior Harbor Cruise to Thursday, July 24 (previously Wednesday, July 23). Same time, same place, just one day later. Should you no longer be able to attend due to this change, want to just onboard last-minute, or have other questions, please reach out to Melanie at melanie@mbex.org or (612) 381-2628. We appreciate your understanding and flexibility!

2.) Deals & Mergers - Architecture and engineering firm TKDA has acquired Minneapolis-based CNA Consulting Engineers, a firm specializing in underground and geotechnical engineering. This acquisition expands TKDA's portfolio nationwide across its four primary markets: industrial and manufacturing, transportation, buildings and sites, and water.

3.) Go Back to School (Maybe) - Trade school enrollment is projected to rise by 6.5% annually through 2030, while college enrollment is expected to drop 15% after this year. Five construction roles are predicted to be in-demand, and they'll offer job security, competitive pay, and advancement opportunities. See what they are

4.) Funding Infrastructure - The United States Department of Transportation (USDOT) awarded $488.1-million in Better Utilizing Investments to Leverage Development (BUILD) grants, and five Minnesota projects were selected in the first round: Aerial Lift Bridge Rehabilitation (Duluth, $11.2M); County State Aid Highway 2 Road and Shared Use Path Improvements (Lower Sioux Indian Community, $25M); Red Lake Road Rehabilitations and Shared Use Path (Red Lake Band of Chippewa Indians, $25M); Robert Street Complete Streets and Viaduct Replacement (MnDOT, $25M); and South Broadway Avenue Plan (Rochester, $2.5M).

5.) How to Beat the Heat - Just remember: 80°, lose the sleeves (eh, it kind of rhymes 😂)

Nonresidential input price escalation has accelerated in 2025, with prices rising at a rapid 6.0% annualized rate through the first half of the year, according to ABC Chief Economist Anirban Basu.

"Despite this acceleration," he said,"prices of many of the inputs most directly affected by tariffs, like iron and steel, declined in June. While it is unclear how and when trade policy will affect construction materials prices, the impact was evident in June's Consumer Price Index release; prices for core goods excluding automobiles rose at the fastest pace since late 2021."

New OSHA Rules Could Cut Company Fines

On July 14th, the U.S. Department of Labor (DOL) updated its guidance on penalty and debt-collection procedures in the Field Manual for the Occupational Safety and Health Administration (OSHA), with new rules taking effect immediately.

These changes are designed to promote voluntary compliance and reward employers for proactive safety measures. The revisions primarily impact how civil penalties are calculated and applied to workplace safety and health violations.

Expanded & New Penalty Reductions and Credits

The DOL made three principal updates to its OSHA Field Manual. It is important to note that these updates are considered distinct adjustments, meaning businesses may be able to take advantage of several or all of them at once.

1.) Expanded Penalty Reduction for Small Employers (up to 70%)

The revised policy increases the eligibility for penalty reductions based on company size. Businesses with up to 25 employees are now eligible for a 70% penalty reduction, an expansion from the previous limit of 10 employees. This adjustment aims to reduce the financial burden on smaller entities, allowing those businesses to redirect resources toward hazard abatement and compliance.

Employers with 26-100 employees may receive a penalty reduction of up to 30%, while those with 101-250 employees are eligible for up to a 10% reduction.

2.) "Quick-Fix" Abatement Credit

A brand-new "Quick-Fix" policy introduces a 15% penalty reduction for employers who immediately correct a hazard identified during an inspection. This program is designed to incentivize rapid hazard correction and to demonstrate an employer's good-faith remedial efforts.

For violations that can be resolved on the spot, abatement must occur in the presence of the OSHA officer. For more complex issues, employers are given a five-day window to complete the fix, with the possibility of an extension up to 10 additional days. The credit is not available for any actions taken more than fifteen days after the condition was discovered by the Compliance Safety and Health Officer.

This credit provides a clear and immediate financial benefit for employers who can and do take prompt and decisive action.

The Quick-Fix reduction is specifically available to all general industry, construction, maritime, and agricultural employers for violations classified as "other-than-serious," "lower gravity serious," or "moderate gravity serious" (but not for "high gravity serious," "willful," "repeated," or "failure-to-abate" violations).

3.) Expanded Reduction for a Clean Compliance History

OSHA has expanded the criteria for receiving a penalty reduction based on compliance history. A 20% reduction is now available to employers who have not been inspected by a federal OSHA or State Plan agency within the last five years, or who have been inspected within that period without receiving any serious, willful, or failure-to-abate violations.

This policy rewards a consistent and proactive commitment to workplace safety by acknowledging the efforts of companies that have a strong track record of compliance. This reduction is applied automatically to eligible employers.

Practical Guidance for Employers

These policy changes are not retroactive and will apply only to penalties issued on or after the effective date of July 14, 2025. Employers should take note of the following guidance to ensure they are prepared:

• Review and Update Safety Protocols: Conduct a thorough self-audit of your existing safety and health programs to identify and address potential violations before an inspection occurs. A comprehensive approach to safety now can significantly reduce your risk of future penalties.

• Prepare for Inspections: Familiarize your designated safety personnel with the new "Quick-Fix" credit to ensure they can act promptly to correct minor violations during an inspection. If your team is prepared to take immediate remedial action, it may directly reduce your potential fines.

• Maintain Detailed Records: Keep meticulous records of safety training, inspection history, and any hazard-abatement actions. Proper documentation will be crucial for substantiating a claim for penalty reductions under the new guidelines.

• Communicate With Your Team: Ensure your employees are aware of their roles in maintaining a safe workplace and are encouraged to report hazards. A well-informed team with open lines of communication is your first line of defense against violations.

CONSTRUCTION HEADLINES

Five construction-related headlines you need to read over the next coffee break.

JOBSITE SAFETY | WORKWEAR

🧢 Work Smarter, Not Hotter: Temperature Regulating Gear That Keeps Crews Going

Staying cool on the jobsite is about more than comfort --- it's a cornerstone of safety. As temperatures rise, so does the body's internal workload. To maintain a stable core temperature, the body redirects energy toward thermoregulation, which can impair physical and mental performance. On high-exertion jobs like construction, where workers are already exposed to direct sunlight, limited airflow, and heavy personal protective equipment, staying cool becomes critical. (For Construction Pros)

GOVERNMENT LEGISLATION | CODES & STANDARDS

🪓 Nixed Energy Efficiency Deduction Could Stymie Office Conversions

President Trump's so-called "Big Beautiful Bill" signed into law July 4th could make owners less likely to renovate troubled properties or convert them to other uses. The bill eliminated the Section 179D commercial building energy deduction, a tax provision established 20 years ago. This measure has been an important incentive for owners to invest in obsolete and financially distressed properties, its supporters say. The new law eliminates the credit starting June 30, 2026. (Building Design + Construction)

ECONOMIC REPORTS

✍️ Construction Planning Climbs Again On Core Sector Momentum

Signs of life are returning to planning desks across the country, as momentum builds behind large-scale projects and complex builds, according to the Dodge Construction Network. The Dodge Momentum Index jumped 6.8% in June. Commercial planning climbed 7.3%, while institutional planning increased 5.7%, according to the report. Slower activity in key sectors, like education, hotels, and retail stores, is likely due to caution around the economic outlook. (Construction Dive)

ARTIFICIAL INTELLIGENCE

🤷 65% of Construction Leaders Haven't Adopted AI

Slate Technologies, an AI-driven solutions company for the construction and real estate industries, shared the results of its first annual "Construction Intelligence" study. Their study uncovered that while nearly 60% of respondents believe the industry is keeping pace with digital transformation, 65% say their companies have not adopted AI or predictive analytics tools for project planning, revealing what Slate Technologies called a "disconnect between industry optimism and on-the-ground implementation." Meanwhile, over 61% of leaders say they see value in AI-powered tools that offer real-time market insights and predictive analytics. (Roofing Contractor)

BUILDING METHODS

🏭 Industrialized Construction: An Era in Building Efficiency

Among the many innovative methods developed to address construction's many significant challenges, industrialized construction, which streamlines the building process through the use of prefabrication, modular building systems, structural precast concrete elements and other advanced manufacturing techniques, continues to grow in demand. Digital integration is fundamental to this approach, with each phase of a project meticulously planned using advanced digital tools, which ensures seamless communication and coordination, enhances precision and allows for more efficient modifications. PROJECT OF THE WEEK

West St. Paul YMCA Site Set for $140M Redevelopment

Read more on Finance & Commerce

The city of West St. Paul has completed an environmental review of Greco's proposed redevelopment of a former YMCA site on Thompson Avenue, a long-anticipated project that will create everything from public amenities to hundreds of new homes.

Last week, the City Council approved a "negative declaration" on the need for an Environmental Impact Statement (EIS) for the redevelopment, thus concluding the environmental review process. The negative declaration advances the roughly $140-million redevelopment to the city entitlement phase.

Up for review are plans for Greco and Swervo Development to redevelop the former YMCA property at 150 Thompson Avenue East --- and adjacent city-owned properties --- with 476 housing units, a restaurant, and public amenities.

In addition to the private development, the city is putting money into a park along the regional trail. Plans include an amphitheater, water feature, and other amenities suitable for community gatherings.

Development will play out in two phases, beginning with a four-story, 272-unit market-rate apartment building. The building will include 75 alcove units, 143 one-bedroom apartments, 40 two-bedrooms, 14 three-bedrooms, and a full "lifestyle amenity package." Also included in the first phase are underground parking, 19 town-homes, a commercial "reuse" of an Auto Zone building and a "build out" of public park amenities.

The second phase, which will break ground one to two years after completion of Phase I, will offer 185 apartments with a similar "lifestyle amenity package."

Greco has submitted formal applications for zoning approvals, which will go to the planning commission on August 19th. City Council reviews will take place on August 25th and September 8th.

Do you interact with City or County officials in the course of your architecture practice?

Over the past two legislative sessions, there have been significant changes to the rules and definitions governing lobbying. AIA Minnesota worked with legislators to better clarify lobbying laws and mitigate the potential impacts on the architecture profession but some interactions with local governments may still require you to register as a lobbyist in certain circumstances.

Jeff Sigurdson will share updated rules and regulations to help you understand how and when your communications with local government officials may constitute lobbying that requires registration with the board.

Join this session to hear about the updated regulations and ask your questions to get clarification on how they may impact your day-to-day practice.
