The New Jersey Graduated Percent Fee: Explained
Last week the Governor signed the Fiscal Year 2026 New Jersey Budget into law, which includes an increase to the Supplemental Fee to the Realty Transfer Fee ("Mansion Tax"), now known as the Graduated Percent Fee. A breakdown of the new tax, which would now be entirely paid for by the seller, is as follows:
- $1 million: The existing 1% “mansion tax” remains, but the responsibility shifts from the buyer to the seller, amending the 2004 law.
- $2 million: 2% tax on the seller.
- $2.5 million: 2.5% tax on the seller.
- $3 million: 3% tax on the seller.
- $3.5 million and above: 3.5% tax on the seller.
To support members through these changes, New Jersey REALTORS® has developed an online Graduated Percent Fee resource page featuring shareable materials and an in-depth FAQ. A recorded webinar is also available, offering a full explanation of the new law and its impact on transactions.
